Terms of sale and use

These terms of sale and use (the « Terms ») govern the relationship between any user (the « User ») and the publisher of Philoscopia, in connection with access to and use of the site www.philoscopia.com and the Philoscopia app (web and mobile, together the « Services »).

Any registration or order entails full acceptance of these Terms in the version in force at the date of the transaction.

1. Seller identification

The seller and publisher of the Services is MF Web, a sole proprietorship (auto-entreprise, France), SIRET 99115781900012. Full details in the legal notice. Contact: contact@philoscopia.com.

2. Description of the Services

Philoscopia is a general-public philosophical companion: an encyclopedia of profiles (philosophers, movements, characters) and a tool for building your own profile. The encyclopedic layer and self-profiling are free; the AI companion (“Philos”) and the experiential layer (journeys, practices) rely on the offers described in article 3.

3. Offers and prices

Prices are stated in euros, all taxes included. The publisher reserves the right to change its prices at any time; pending orders are billed at the price in force when they are validated.

3.1 Free

The encyclopedic layer and self-profiling are available for free, without limit. The AI companion includes a free monthly allowance (on the order of 30 fast-tier messages). The first act of every journey is open.

3.2 AI credits

In the credits regime, the companion is paid for with prepaid credits bought in packs via Stripe. Credits are debited at real cost for each generation (1 credit = €0.001 of billed value): the debit depends on the model, the length of the conversation and the tools used, and remains displayed after each reply. Unused credits do not expire while the account is active.

3.3 Lifetime unlock of the experiential layer

A one-time purchase granting access, with no time limit, to all journeys and the full detail of every practice.

3.4 Your own key (BYOK) and your own server

You may use your own OpenRouter key or your own endpoint: in that case requests do not go through our relay, no credit is debited, and this regime is free on our side (you pay your provider directly).

3.5 Donations

You may support the project with a free (« pay what you want ») donation via Stripe. A donation grants no counterpart or access: it is not a sale, and it is not refundable.

4. Ordering and payment

Purchases are made from the app, after creating an account, via the secure Stripe payment page. The publisher neither receives nor stores any banking data. The contract is concluded and access activated as soon as the provider confirms the payment.

A confirmation is sent by email. An invoice can be obtained on request at contact@philoscopia.com.

5. Right of withdrawal

In accordance with article L221-28 13° of the French Consumer Code, the 14-day right of withdrawal does not apply to the supply of digital content not provided on a tangible medium whose performance began after the consumer's prior express agreement and express waiver of that right.

By validating their order (credits, unlock), the User requests immediate performance and acknowledges that they expressly waive their 14-day right of withdrawal. Donations are not sales and are not refundable.

6. Refund policy

Beyond the legal warranties (article 8) and the cases provided for by law, orders give no right to a refund, the right of withdrawal having been expressly waived (article 5).

As a commercial gesture, the publisher may grant, at its sole discretion, a refund within 14 days of purchase, provided use has been minimal (unused credits, or an unlock with minimal use). Any request must be sent to contact@philoscopia.com, stating the reason and the purchase date.

7. User account

Access to personalised features requires creating a personal account. The User undertakes to provide accurate information and is solely responsible for the confidentiality of their credentials and for any activity carried out from their account. The account is strictly personal and non-transferable.

The User may delete their account at any time from their account area or by writing to contact@philoscopia.com. Deletion gives no right to a refund of amounts paid.

7.1 Minor users

In accordance with article 8 of the GDPR, Users under 16 must obtain the consent of a holder of parental authority before any registration and any purchase. Purchases made by a minor without authorisation may, on evidence, be refunded.

8. Legal warranties

Independently of any commercial warranty, the seller remains bound by the legal warranty of conformity (articles L.217-3 et seq. of the Consumer Code) and the warranty against latent defects (articles 1641 et seq. of the Civil Code). Any such claim must be sent to contact@philoscopia.com within 2 years of the supply of the Service.

9. Use of the Services

The User undertakes to:

  • use the Services strictly for personal, non-commercial purposes;
  • reuse the open encyclopedic layer only under the open-source licences of the repository (CC BY-SA for content, MIT for code);
  • not copy, scrape (unauthorised scraping) or misappropriate the private Services (journeys, practices, companion), the design or the brand;
  • not attempt to circumvent access-control, authentication or payment mechanisms, nor disrupt the operation of the Services.

In case of breach, the publisher reserves the right to suspend or terminate the account without notice or refund, without prejudice to any legal action.

10. Intellectual property

The open encyclopedic layer is published under an open-source licence; the other elements remain the exclusive property of the publisher. See the legal notice.

11. Personal data

The processing of personal data is detailed in the privacy policy, compliant with the GDPR.

12. Availability and maintenance

The publisher strives to provide continuous access to the Services, except for maintenance operations and cases of force majeure. An occasional interruption does not engage the publisher's liability and gives no right to a refund, unless it is significant and prolonged and renders the Service unusable.

13. Liability

Philoscopia's content is provided for guidance, for the purpose of reflection; the AI companion may produce errors. The publisher's liability cannot be engaged for indirect damage, nor beyond the amount actually paid by the User for the Service concerned over the last 12 months.

14. Force majeure

Neither party may be held liable for a failure to perform its obligations resulting from a case of force majeure within the meaning of article 1218 of the Civil Code.

15. Changes to the Terms

The publisher reserves the right to modify these Terms. Substantial changes will be notified to the User. Pending orders remain governed by the version accepted when they were placed.

16. Mediation and dispute resolution

In the event of a dispute, the User is invited first to contact the publisher at contact@philoscopia.com to seek an amicable solution.

In accordance with article L612-1 of the French Consumer Code, a consumer may resort free of charge to a consumer mediator. Philoscopia's competent mediator is being designated; their details will be published on this page as soon as registered.

A consumer User may also use the European online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

17. Governing law and jurisdiction

These Terms are governed by French law. Failing an amicable resolution or mediation, the French courts shall have sole jurisdiction, subject to the mandatory provisions applicable to consumers.
